Man in Tactical Gear Shot After Charging at Officers With a Crowbar
Carmel-by-the-Sea, California — On the morning of October 25, 2024, a tense confrontation unfolded in a quiet neighborhood that ultimately ended in tragedy. Carmel Police Department officers were called to respond to multiple 911 reports of a suspicious and potentially dangerous man moving through the area.
Callers described the man as heavily equipped and armed, wearing tactical-style gear. He was identified as 27-year-old James Marshall, a resident of the neighborhood. Witnesses reported that Marshall carried pepper spray, a knife, a 3-foot-long crowbar, and what appeared to be a rifle. These alarming details prompted an urgent and coordinated police response.
Carmel Police Chief Paul Tomasi, along with Sergeant Gerald Maldonado and Officer Rene Guevara, staged near Marshall’s residence while attempting to locate him. At that time, his exact whereabouts were unknown, and officers were on high alert, preparing for a potentially volatile encounter.
At approximately 10:07 a.m., officers spotted Marshall walking along the sidewalk directly in front of his home. His appearance, combined with the weapons he was reportedly carrying, escalated the threat level. Moments later, Marshall moved toward his driveway. In an attempt to subdue him without lethal force, Sgt. Maldonado fired bean bag rounds as Marshall faced the sidewalk. The less-lethal rounds appeared to have no effect. Later, investigators recovered a BB rifle from the location where Marshall had been standing.
Marshall ignored repeated commands and fled toward the backyard of his residence, with officers in pursuit. Despite being hit with additional bean bag rounds, he continued to resist and refused to comply with police instructions. His behavior grew more aggressive as the confrontation intensified.
The situation took a deadly turn when Marshall charged at Sgt. Maldonado with the crowbar raised. Fearing for the sergeant’s life, Officer Rene Guevara, who had been providing cover, responded by firing five consecutive shots from his service pistol. No other officer discharged lethal rounds during the incident.
Though mortally wounded, Marshall displayed remarkable resistance. He continued to advance toward officers, ignoring commands and showing no signs of surrender. In an effort to stop him, officers deployed more bean bag rounds and even attempted to incapacitate him with a taser, but both measures proved ineffective.
Approximately forty seconds after the lethal shots were fired, Officer Guevara made the decision to physically tackle Marshall to the ground. With the combined effort of the officers present, Marshall was finally restrained and placed in handcuffs.
Recognizing the severity of his injuries, officers on the scene immediately began to administer life-saving medical aid. Emergency medical responders soon arrived and took over treatment. Marshall was transported to Natividad Medical Center (NMC). Despite the urgent medical efforts, he was later pronounced deceased.
During the post-incident review, investigators discovered that Marshall had been wearing ballistic body armor that provided protection to both his front and back. Evidence indicated that the vest successfully stopped at least one bullet fired by Officer Guevara, potentially prolonging Marshall’s ability to resist even after sustaining multiple gunshot wounds.
Authorities emphasized that officers initially attempted to resolve the situation using non-lethal tactics, including bean bag rounds and tasers, before resorting to deadly force. However, when Marshall directly attacked Sgt. Maldonado with a crowbar, the officers were left with little choice but to escalate to lethal means in order to protect themselves.
The Carmel Police Department acknowledged the incident as a tragic outcome for both the officers involved and the community. While the suspect’s motivations remain under investigation, the sequence of events underscored the unpredictability of armed encounters and the dangers faced by law enforcement when suspects refuse to comply with commands.
Neighbors described the confrontation as both shocking and frightening. Residents who witnessed portions of the incident reported hearing loud bangs, followed by gunfire and shouting, as the usually peaceful neighborhood became the scene of a life-or-death struggle.
